Starting this year, the deadlines for submitting the System Economic Information (IES) have been advanced; therefore, the IES form must be submitted from June 1st to July 31st, 2015, as governed by Resolution No. 397/13/CONS, as amended by Resolution No. 235/15/CONS.

I soggetti obbligati sono gli operatori di rete, i fornitori di un bouquet di programmi pay tv, i fornitori di servizi di media audiovisivi o radiofonici, i fornitori di servizi interattivi associati e/o di servizi di accesso condizionato, i soggetti esercenti l'attività di radiodiffusione, le imprese concessionarie di pubblicità (ivi compresi i soggetti che esercitano attività di pubblicità online e pubblicità cinematografica), le agenzie di stampa a carattere nazionale (ivi compresi i soggetti i cui notiziari siano distribuiti in abbonamento, a titolo oneroso, qualunque sia il mezzo di trasmissione utilizzato, ad almeno un editore a carattere nazionale che realizzi un prodotto ai sensi della legge n. 62 del 2001), gli editori, anche in formato elettronico, di giornali quotidiani, periodici o riviste, altre pubblicazioni periodiche ed annuaristiche e altri prodotti editoriali.

The obligated parties are network operators, providers of pay-TV program bouquets, providers of audiovisual or radio media services, providers of associated interactive services and/or conditional access services, broadcasters, advertising concessionaires (including entities engaged in online advertising and cinema advertising), national press agencies (including entities whose news bulletins are distributed by subscription, for a fee, regardless of the transmission medium used, to at least one national publisher that creates a product pursuant to Law No. 62 of 2001), publishers, including in electronic format, of daily newspapers, periodicals or magazines, other periodical and annual publications, and other editorial products.

Entities that, although obliged under the aforementioned legislation, have total revenues in the reference year—including public grants and agreements with public bodies—referable to the activities monitored by the System Economic Information equal to zero euros, are exempt from the obligation to submit the System Economic Information. 

Any non-compliance is punishable pursuant to Art. 6 of Resolution No. 397/13/CONS. Naturally, the other obligations of the aforementioned entities remain in force, including registration with the Register of Communication Operators (ROC). 

The fulfillment consists of completing the attached electronic form, which must be sent to the Authority from a certified email address (PEC) to ies@cert.agcom.it (this address can be used solely and exclusively to transmit the form. The form can be received solely and exclusively through this email address).

The form consists of a file in a dynamic PDF format, which can be filled out electronically according to the instructions in the guide and the specific instructions for each business sector (radio and television, publishing, internet, and advertising concessionaires).

Please note that only forms transmitted in their original dynamic format will be considered valid (scanned copies of the form, for example, will not be accepted), as the automatic acquisition system from the certified email inbox is unable to interpret other formats and/or other attachments.

Therefore, obligated parties are invited to include any necessary clarifications and specifications in the notes to the form without attaching other files, which, in any case, cannot be acquired by the system.

Furthermore, it is recommended to send only one form per email.
